1. Why is it necessary to conclude a contract between Kyivvodokanal and the co-owners of an apartment building?
The conclusion of a contract for the provision of centralized water supply and centralized wastewater services between the service provider and the co-owners (individuals, individual entrepreneurs and legal entities) of an apartment building is provided for by the Law of Ukraine "On Housing and Communal Services".
2. What is a public contract or public offer?
According to Part 1 and 2 of Article 633 of the Civil Code of Ukraine, a public contract is a contract in which one party has undertaken the obligation to provide services to anyone who applies to it. The terms of a public contract are set the same for all consumers
A public offer is an offer of a business entity, addressed to any person in accordance with Article 633 of the Civil Code of Ukraine, directed to an unspecified circle of persons, to conclude a contract with him for the provision of services on the terms contained in the public offer.

In connection with the adoption of the Resolution of the Cabinet of Ministers of Ukraine dated 29.12.2023 No. 1405 “On Amendments to Certain Resolutions of the Cabinet of Ministers of Ukraine on Payment for Housing and Communal Services”, which amended the Rules for the Provision of Services for Centralized Water Supply and Centralized Water Drainage and Standard Agreements for the Provision of Services for Centralized Water Supply and Centralized Water Drainage, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 05.07.2019 No. 690, and guided by the norms of Part 5, Article 13 of the Law of Ukraine “On Housing and Communal Services”, Art. Art. 633, 634 of the Civil Code of Ukraine, PrJSC "AK "Kyivvodokanal" publishes this public proposal (offer) for the conclusion of:
- a public individual contract for the provision of services for centralized water supply and/or centralized water drainage for consumers-owners (co-owners, users) of residential and non-residential premises in an apartment building, other real estate objects or water supply and/or water drainage in an apartment building connected to intra-building networks, who receive services to meet their own needs, as well as to ensure the economic, technological (own) needs of the apartment building as a whole;
- a public individual contract for the provision of centralized water supply and/or centralized wastewater services for consumers-owners (users) of individual (manor) houses that are connected to centralized water supply and/or centralized wastewater networks in accordance with the requirements of the Rules for the Use of Centralized Drinking Water Supply and Centralized Wastewater Systems in Settlements of Ukraine, approved by the Order of the Ministry of Housing and Communal Services of Ukraine dated 06/27/2008 No. 190 (as amended by the Order of the Ministry of Community and Territorial Development of Ukraine dated 04/19/2021 No. 97).
The agreement concluded with the co-owners of apartment buildings is considered concluded if, within 30 days from the date of publication of the text of the agreement on the website of PrJSC "AK "Kyivvodokanal", the co-owners of the apartment building have not made a decision on the choice of a model of contractual relations and have not concluded a corresponding agreement with the Company.
The agreement concluded with the owners (users) of individual (manor) residential buildings is considered concluded if, within 30 days from the date of publication of the text of the agreement on the website of PrJSC "AK "Kyivvodokanal", such an owner has not taken any action to disconnect (refuse) from centralized water supply and/or centralized wastewater services.
Due to the fact that these agreements are connection agreements, their terms are not subject to agreement with the connecting party (consumer).
The contracts are posted on the website of PrJSC "AK "Kyivvodokanal" in free access and in a manner that ensures familiarization with their contents by every person who receives and applies to the Company to receive centralized water supply and/or centralized wastewater services.

Due to the fact that this Agreement is an accession agreement, its terms are not subject to coordination with the joining party (consumer).

In accordance with the requirements of the Law of Ukraine dated 03.12.2020 No. 1060-ИХ “On Amendments to Certain Laws of Ukraine Regarding the Regulation of Certain Issues in the Field of Provision of Housing and Communal Services”, amendments were made to the Resolution of the National Commission for State Regulation in the Field of Energy and Communal Services dated 16.06.2016 No. 1141 “On Establishing Tariffs for Centralized Water Supply and Sewerage”, according to which all sales costs that should be included in the subscriber service fee for all individual consumers were excluded from the structure of tariffs for centralized water supply and centralized water disposal.
Taking into account the above, PrJSC "AK "Kyivvodokanal" publishes this public proposal (offer) for the conclusion of a public individual connection agreement for the provision of centralized water supply and/or centralized water disposal services (hereinafter referred to as the Agreement) with a new amount of the subscriber service fee, which applies to consumers - owners (co-owners, users) of residential and non-residential premises in an apartment building, other real estate objects or water supply and/or water disposal in an apartment building, connected to intra-building networks, who receive services to meet their own needs, as well as to ensure the economic, technological (own) needs of the apartment building as a whole.
The agreement is considered concluded if, within 30 days from the date of publication of the text of the agreement on the website of PrJSC "AK "Kyivvodokanal", the co-owners of the apartment building have not made a decision on the choice of a model of contractual relations and have not concluded a corresponding agreement with the Company.

The form of the Agreement between the consumer and the service provider (Kyivvodokanal) is a public offer, that is, it is actually valid by default, if your house has not made a decision on choosing a model of contractual relations and has not concluded an agreement with PrJSC "AK "Kyivvodokanal".
